In recent years, some jurisdictions have seen a backlash against corporate social responsibility (CSR), implying that the state’s role is reversing from facilitating and mandating to prohibiting and undermining CSR. In this article, Brejnholt, Rintamäki and Schnyder argue that corporate discretion needs to be conceived as both the liberty to adopt or not adopt CSR practices and the ability to do so.
